I understand that the Melbourne Firefighter Stair Climb event (the Event) includes climbing stairs while wearing personal protective equipment and using breathing apparatus weighing approximately 25 kilograms and that the use of breathing apparatus may significantly affect normal respiration (the Event Activities).

I understand that the Event Activities are potentially dangerous and carry the risk of serious injury, serious illness and death.

I have read the above warning and I declare that I am physically and mentally able to participate in the Event. I agree to participate in the Event in a way which is consistent with my skill level and physical and mental capability.

I have read and understood the Event rules and will attend the safety briefing on the day.

I consent to receiving emergency medical treatment at the Event and transportation to obtain medical treatment if the 000 Foundation determines that this is necessary.

Alternatively, if I am participating as a virtual climber, I agree to the virtual climb rules.

I acknowledge that the Event is organised and operated by the 000Foundation Limited (000Foundation). The 000Foundation is a company limited by guarantee and is not related to, directed or operated by Fire Rescue Victoria (FRV) or any other emergency services organisation.

I agree that my participation in the Event is voluntary.

I take full responsibility for my actions, and my own personal safety. I agree that the 000Foundation and/or FRV is not liable in respect of any injuries, loss or damage suffered or sustained by me, as a result of participating in the Event, except for any liability which cannot be excluded by law.

I release the 000Foundation and FRV from all liability for a failure to comply with any express or implied warranty or guarantee that the Event will be conducted with reasonable care and skill, in so far as the Event results in my death or personal injury, but not including personal injury or death caused by the 000Foundation’s reckless conduct.

I agree to indemnify and hold harmless 000Foundation and/or FRV for any injury, loss or damage sustained by me to the extent that such injury, loss or damage is due to my own negligence or the negligence of any other participant in the Event.

I confirm that this waiver is a true and accurate record of my physical and mental capacity to compete in the Event.

Any provision of this waiver, which is or becomes illegal, void or unenforceable in any jurisdiction: a. is severable; b. will be ineffective and severable in that jurisdiction to the extent of the illegality, voidness or unenforceability; c. will not invalidate the remaining provisions of this document; and d. will not affect the validity or enforceability of that provision in any other jurisdiction.
